Program Description & General Topics: The panel will cover issues related to protecting attorney-client privilege after selective disclosure, including the common interest privilege and joint defense privilege. The panel will review the basics of the applicable law in the Second Circuit, discuss why early awareness of these issues is important, and identify some practical strategies to protect the privilege and avoid unintended privilege waiver in these circumstances.
